Terms of Service

The Unilever Staff North Rocks Online Store UShop (the “Platform” or “NRK Staff Shop”) and related services are made available to you by Unilever Australia (Holdings) Pty Ltd (“Unilever”). Please read this document carefully before placing any orders on the Platform.

1. REGISTRATION

To use some of the services or features made available to you on this Platform, you will need to register. When you register, you are required to provide information about yourself that is true, accurate, current and complete in all respects.

2. ELIGIBILITY TO PURCHASE

2.1 In order to make purchases through the Platform, you will be requested to register and provide your personal information. In particular, customers must provide their real name, phone number, e-mail address, delivery address and other requested information as indicated.
 
2.2 The Platform is limited to individuals and others who meet the North Rocks Staff Shop terms of eligibility.
 

 3. PRIVACY AND PERSONAL DATA PROTECTION

By submitting an order you accept the Unilever ANZ Privacy Notice:
 

4. ORDERS

4.1 All orders are subject to acceptance by Unilever. Once accepted the Office Facilities team will fulfil your order and arrange delivery of the products to you at the location indicated in your registration if you work from home, or make the products available for collection if you work in the North Rocks office.
 
4.2 Orders cannot exceed $50 per month (including any delivery fee) to clear your credits. Your tax invoice will be provided with the products you have ordered.
 
4.3 If you work from home and place a company shop order, a $7 delivery fee will be deducted from your credit. You cannot collect or have someone collect it for you if you are ordering when working from home.
 
4.4 If you work in the North Rocks office, your order will be picked by the Office Facilities team for your collection and a delivery fee will not apply.
 
4.5 We may cancel your order if the product is not available for any reason.  We will notify you if this is the case and refund any payment that you have made.
 
4.6 To the extent permitted by law no refunds and/ or returns are allowed.
 

5. PRICING POLICY & RANGE

5.1 Pricing is subject to change as determined by Unilever.
 
5.2 The range of products for sale on the order form may be limited subject to availability and may change.
 
5.3 All prices are in Australian dollars and where applicable, inclusive of all GST (as that term is defined in A New Tax System (Goods and Services Tax) Act 1999 (Cth)).
 

6. REJECTION OF YOUR ORDER

6.1 Unilever reserves the right not to accept an order at its sole discretion including, but not limited to, situations where you are not entitled to company shop credits, have not correctly indicated the delivery fee or where an order is placed for more than $50 or more often than once a month.

7. CREDIT USAGE

7.1 You can only pay for products by using your shop credit entitlements. It is not possible to use credit cards to supplement payment.
 
7.2 From 1 October 2020 a $25 credit will be applied per month instead of the $50 cycle every 2 months.
 
7.3 From 1 October 2020 to 30 June 2021 a $25 credit will be applied per month   and any credits must be cleared by 30 June 2021. Any remaining credit on 30 June 2021 will cease at that date. From 1 July 2021 the $25 credit that is applied each month must be used in the same month and any remaining credit will cease at the end of each month.
 

8. DELIVERY

8.1 Estimated delivery times is 2-5 days after the Office Facilities team have processed the order.
 
8.2 The delivery to the address you entered when registering will be at your risk, it needs to be somewhere safe as the parcel will be left for you and will not be redelivered. You must ensure that the shipping address provided to us is correct.
 

9. DEFECTIVE PRODUCTS

9.1 Subject to clause 9.2, there is no acceptance of returns and/or credits except when required by law.

9.2 If the product is confirmed to have a defect, we will replace the product or refund the price of the product to your original payment method, as appropriate. It does not constitute as a defect if in our reasonable opinion a product has become of unacceptable quality following the sale to you due to fair wear and tear, misuse, failure to use in accordance with usage instructions, using it in an abnormal way or failure to take reasonable care.

10. NO COMMERCIAL USE

10.1 This Platform is for your personal, non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any content, software, products, or services contained within this Platform. You may not use this Platform, or any of its Content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own Platform.

11. YOUR ACTIVITY

11.1 You agree that you will be personally responsible for your use of this Platform and for all of your communication and activity on and pursuant to this Platform. If we determine that you are or have been engaged in prohibited activities or otherwise violated this benefit, we may deny you access to this Platform on a temporary or permanent basis.

12. LIMITATION OF LIABILITY

12.1 To the extent permitted by law, Unilever is not liable to you for any loss or damage (whether direct, indirect, consequential or special) either in negligence, other tort, breach of contract, breach of warranty arising out of or in connection with these Terms & Conditions and these Terms of Use or your use of the Platform, including any loss or corruption of data, interference with or damage to your computer or any interruption, delay or failure in the Platform.

12.2 Nothing in these Terms excludes or limits your statutory rights as a consumer or our liability for:

(a) fraud;
(b) death or personal injury caused by our breach of duty;
(c) any breach of the obligations implied or guaranteed by law; or
(d) any other liability which cannot be excluded or limited by applicable law.
 

12.3 We are also not responsible for failure to meet any of our obligations under the platform where such failure is due to events which are beyond our reasonable control.

13. INDEMNITY

13.1 At our request, you agree to indemnify Unilever, defend us and hold Unilever Australia (Holdings) Pty Ltd, its officers, directors, agents, affiliates, licensors, and suppliers, from and against all liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of these terms and conditions by you including the use by any other persons accessing this Platform using your Internet account caused by your action or inaction.

14. GOVERNING LAW
 

14.1 These terms together with all our policies and procedures will be governed by and construed in accordance with the laws of New South Wales.
